By downloading, installing, or using the Fables Magic application ("Application"), you expressly agree to these Terms of Use ("Terms"). If you do not agree to these terms, do not use the Application.
1. The Service and Eligibility
Fables Magic is a tool developed for parents, grandparents, and educators to create and share meaningful, bonding moments by telling personalized children's stories, generated with the support of Artificial Intelligence technologies. To create an account and use the Application, you must be at least 18 years of age (or the legal age of majority in your jurisdiction). When submitting names, ages, or personal characteristics of minors to personalize stories, you represent and warrant that you are the child's parent or legal guardian, or that you have obtained express consent from them for this purpose. You are solely responsible for all content you input, type, or upload through the Application.
2. Acceptable Use
You agree NOT to use the Application to:
• Input any illegal, hateful, abusive, defamatory, pornographic, or inappropriate content for a family and child-friendly environment.
• Violate the privacy or intellectual property rights of third parties.
• Attempt to gain unauthorized access to our systems, servers, or networks.
• Perform reverse engineering, decompile, attempt to extract the source code, or reproduce the underlying technology of the Application.
We utilize automated moderation services to verify submitted content. We reserve the right to remove any content and immediately suspend or terminate accounts that violate these Terms, without the right to a refund of current fees.
3. Plans, Subscriptions, and Payments
• Evaluation (Trial): We may offer a free trial period that grants temporary access to Subscriber Plan features.
• Free Plan: Following the trial period, if you do not subscribe to a plan, your account will remain on the Free Plan, subject to usage limits defined by your balance of Seeds (in-app usage units/credits).
• Subscriber Plan: For unlimited or expanded access, you may purchase a recurring monthly or annual subscription. Billing will be processed through your Google Play Store or App Store account and will renew automatically unless canceled in your respective store settings at least 24 hours before the end of the current billing cycle.
• Seed Packages: You may purchase additional Seeds through the Magic Shop at any time. Except where mandated by applicable consumer protection laws or specific Google Play Store or App Store refund policies, purchased Seeds are non-refundable, non-transferable, and cannot be redeemed for cash.
4. Intellectual Property and Rights of Use
Our Content and Technology: The entire Application, including but not limited to its design, visual interface, logos, source code, databases, software architecture, institutional texts, and algorithms, is the exclusive property of and protected by copyright and intellectual property laws of Clipeus Tecnologia Ltda, registered in Brazil under Corporate Taxpayer ID (CNPJ) 11.451.434/0001-24. Use of the Application does not transfer to the user any ownership rights over it.
Your Content: You retain rights over the original and authored content that you lawfully input into the platform.
Generated Stories: The children's stories generated by the platform are made available strictly for your personal, family, and non-commercial use. Commercialization, resale, mass publication, licensing, or commercial distribution of stories generated by the Application is strictly prohibited without the prior and express written authorization of Clipeus Tecnologia Ltda.
5. Limitation of Liability and AI-Generated Content
The Application is provided "as is." Stories and visual elements are generated by generative artificial intelligence models for recreational and family bonding purposes. Although automated moderation filters are implemented, narratives may occasionally present logical inconsistencies or unforeseen fictional elements; parents or guardians are responsible for the final supervision of the reading and the content shared with the child. To the maximum extent permitted by applicable law, Clipeus Tecnologia Ltda shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the service, connection failures, or interruptions in AI content generation.
6. Privacy
The processing of your personal data and information entered into the Application is governed by our Privacy Policy, which complements these Terms and should be read in conjunction with this document.
7. Changes to the Terms
We reserve the right to modify these Terms at any time. Substantial changes will be communicated through the Application itself or via email. Continued use of the Application after changes constitutes your agreement to the new terms.
8. Termination and Account Deletion
We may suspend or terminate your account access immediately, without prior notice, in the event of a violation of these Terms. You may also close your account at any time by requesting permanent deletion via the "Delete My Account" option available in the Application, or by contacting our support team via email. For canceling recurring subscription charges, the cancellation must be processed directly through your Google Play Store or App Store account settings.

10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil. Any disputes or claims arising out of or in connection with the use of the Application shall be subject to the exclusive jurisdiction of the competent courts located in the judicial district of Clipeus Tecnologia Ltda's registered headquarters, expressly waiving any other jurisdiction, however privileged it may be.
